Libertas the Lawyers League and PAHRA (Philippine Alliance for Human Rights Advocates) organized an E-Lawyering Project for the victims of Extra Judicial Killing, Enforced Disappearance and Torture. The Bangsamoro Center for Justpeace in the Phils. (BCJP) is one of the HRD’s assign in ARMM covering the areas of Lanao, Maguindanao and Cotabato City.
We are calling to all our partner organizations I/NGO, CSO’s and PO’s who advocates for the Human Rights Violation that if you have documented any incidents on this cases please contact us through email (bc.justpeace@gmail.net) or call us on 064-3902726.If you have any questions or clarifications please do so. Help us campaign “ STOP human rights violation”.
OBJECTIVES
*      To assist in preventing EJKs, EDs, acts of torture, and other human rights violations by providing legal counseling and representation in asserting the civil rights of the victims and HR defenders as these incidents transpire;
*      To assist in prosecuting EJKs, EDs, acts of torture, and other human rights violations by providing legal counseling to HR defenders in effectively documenting the incident;
*      To educate human rights victims and HR defenders about their rights and the remedies available to redress violations thereof;
*      To assist in referring human rights victims and defenders to legal service providers in the locality who can defend/prosecute cases before the prosecutors and in court.
SCOPE OF MOBILE LAWYERING SERVICES
*      Legal Advice, including appropriate steps and remedies to be undertaken by HRDs/victims/relatives.
*      Talk to relevant authorities in the field (PNP, AFP, CHR) as the incidents transpire.
*      Refer the incident to network members for further legal assistance/handling of case.
*      Assist in the Preparation of the incident report.
*      Assist in the preparation of complaints/petitions and other pleadings

Libertas league of Lawyers with PAHRA is in a partnership project called "E-Lawyering" (electronic lawyering) which will run for one year from July 1, 2012.  Pools of lawyers are on stand-by 12 hours (8 am - 8pm) a day and can be accessed through a call dispatcher who will alert the lawyer-on-duty.

The Lawyer will call the HRD for emergency legal advice needed by the victim as the latter's temporary legal counsel. The lawyer will also talk to authorities (Police/Military/Prosecutor, etc.) as necessary thus preventing further violations of rights of the victims and ensuring due process. 

Part of the project are 6 HRDs from (2) - ARMM, (2)-Reg 3, Reg 12, Reg 6 which are the priority areas of the project. However, Libertas agreed to PAHRA's request that reports of HRVs from other areas will also be accepted. 

CASES to be accepted are those emergencies in nature:  
With risk to life, security and property and specific cases of violation against women 
Arrest/Detention, Enforced Disappearance, Extra Judicial Killings, Torture
Rape in the context of IHL (International Humanitarian Law) and Arrest/Harassments of Women sex workers/prositute.

The perpetrators should be State authorities. The cause of violations need not be civil and political in nature only. Those cases of eco-soc rights violation will be accepted such as from mining, agricultural, environmental, labor disputes struggle areas.  

After each incident reported to the E-lawyering, all cases are expected to be documented using the CSO-Peoples Intervention and Monitoring Mechanism (CSO_PIMM).

To ensure security of system, only calls/SMS coming from our identified and reliable HRDs in our areas of work will be entertained.

CALLING HUMAN ALL RIGHTS LAWYER! SAVE LANAO AND MARAWI CITY FROM AFP's Oppression!


What happen to the "Jutsice system" in this part of the Archipelago(MARAWI CITY). Yesterday around 11 PM midnight, while everybody is enjoying the spirit of Ramadhan---a group of Law and former Students decided to bond and Visit one of the Cafe shop here in MArawi City--while they are 'bout to unload suddenly AFP elements belonging to 65th IB riding a korean type Army Car arrived and surrounded them and point their GUNS to this Poor students---they interogated one of them the driver who just 'bought the car whom i refuse to identify for reasons that there's case now in the court---the AFP elements without warrant of arrest accused the driver that his car is Marked only to turn out that the car is legal and clean but the AFP elements out of desperation--searched without warrant the CAR a hidden 38 revolver was found inside the CAR---because of frustration they took the driver to Agus 1 where the 65th IB is encamped---because of this reports already circulated in the RADIO and i was one of them who went to that CAMP to check---there were RUMORS that AFP elements summarily execute thier victims inside the camp---to my surprise while approaching the gate a drunk Soldier asking us why we are there i told him we just want to check the condition of that they are detaining---but he appears to be looking for a fight raising his voice against us---when the soldiers learnt that the one they took is a student leader and human rights Volunteer--they don't want to comment and said they will leave that to the due course of the LAW daw? searching w out warrants and illegal detention?...early Morning Friends and Relatives of that detained work   for his release----but not until afternoon where no Judge is around did they turned over and filed a case---so they can craft a case for they know they did something wrong--also this afternoon they released the CAR---even Prosecutors are affraid of this un usual movements by Military---this afternnon i checked at PNP HQ in MArawi CIty a similar case they also relate to us--another case of torture--the AFP turned over a man whom they accuse of Illegal position of fire arms---since no friends and relatives got to check on him he was tortured as in "Basag ang MUKHA"---san kami pupunta at hihingi ng tulong since our Politicians doe's not want to speak kasi baka mawalan sila ng security whom the AFP is providing the FEW na me kaya?---i learn from a source that the same 65th IB is the infantry assigned in MAguindanao during the "AMPATUAN MASSACRE" if this is the kind of behaviour that they are showing and GOD FORBID baka mangyare din sa lanao. wag sana...calling International HUman Rights Group to look into this Illegal detentions and Illegal arrests! We strongly condemn this kind of Acts!

Incident Report




Last July 24, 2012 at around 10:00 a.m. a shooting incident was happened in the Barangay Kanguan,Datu Piang,Maguindanao. The Municipal ABC president and at the same time the Barangay chairman of Barangay Kalipapa,Edris Ali and his son Kagawad Satol Ali of the said barangay were being shoot. According to the PNP who investigated, the victims attended a weekly session of the entire barangay chairman in all covered barangays in the Municipal Hall. While they were on their way back home riding their single motorcycle closes to the restaurant of one of the Tiyakap Kawagib team leader-Akmad Ali were the incident took place, an identified suspect immediately shoot down the said victims. They were brought to the clinic but suddenly Barangay Chairman died and his son was dead on the spot. The PNP said that Rido is the possible main root cause of the incident.

PCID supports the passage of the RH Bill in ARMM

Quezon City (July 24, 2012)

The Regional Legislative Assembly (RLA) in the ARMM held a consultative meeting on the RH Bill on July 18 at the Alnor Hotel and Convention Center in Cotabato City. The meeting was attended by representatives from sectors such as business, religious, women, youth, and media.

The Philippine Center for Islam and Democracy (PCID) supports the passage of the RH Bill in the Autonomous Region in Muslim Mindanao (ARMM) in line with its work promoting maternal and child health in the region known to be the most dangerous to pregnant women and infants.

PCID and the Magbassa Kita Foundation (MKFI) have organized the Noorus Salam (Light of Peace), the first national network of Muslim women religious (aleemat and ustadzas) and civil society leaders, working to capacitate women in peace and development efforts.

PCID believes the RH Bill will address the crucial and difficult role of marginalized women in ARMM as they contend with not only raising a family in poverty, amid uncertain conditions brought about by continuous conflict in the region.

Most importantly, the bill is a direct response to the Tanzim al-Usra – the official ruling (fatwah) on reproductive health and family planning – released by the Assembly of Darul-Iftah of the Philippines in 2003 supporting birth spacing, delaying pregnancy, and use of safe and legal contraceptives with ultimate goal of promoting the health and welfare of the family, in particular; and the society, in general.

PCID lauds the efforts and courage of RLA assistant majority floor leader Irene P. Tillah and Samira Gutoc-Tomawis (sectoral representative for women), as well as the Assemblymen for coming up with a piece of legislation that would address the largely neglected needs of women in the ARMM, the region being the most dangerous to childbearing women and to babies.

The passage of the RH Bill will have an immense impact on the current situation of women in ARMM in many ways, among others:
It will make reproductive health care services more accessible for women in the region who can hardly afford health care especially when the regional government will be mandated to provide such services.
Abortion, while remaining illegal and punishable by law, would not be a hindrance for women to avail of post-abortion care to be provided for by government in a “humane, non judgmental, and compassionate manner.”
The region will benefit from additional hospitals and improvement of existing facilities to accommodate emergency obstetric and neonatal care as called for in the Bill providing at least one hospital per 500,000 inhabitants.
The integration of responsible parenthood and family planning in anti-poverty programs will mean more government support.

PCID is one with the proponents in pushing for the passage of the RH Bill as the RLA prepares for deliberations.

Re: SONA overlooked the ARMM WATCH

THE UNSUNG IN THE SONA, WITH SOMETHING OF EVERYTHING

Civilians no longer sultans are taking on a "royal" role in reforming their communities. They may not be holding positions but their platforms are cyberspace and fora where they even engage the United Nations affiliates.

I received text messages that the SONA didn't get to speak much about the peace process and note this was Ramadhan month. But the few lines about Muslim Mindanao were to be proud of with a citation of the ARMM OIC Governor Mujiv Hataman as a "certified" ghost-buster. Shouldn't one prepare for a future Bangsamoro better autonomy by training us better in self-government? With his usual stinging quotes, PNOY talked of the multo (ghosts) ng elections who will no longer appear (the multiple registrants) . I took pride that our Committee's issue on Education was the major focus and priority in the SONA with a goal to provide every student with a chair and textbook. Madaris is something I feel strongly about so I hope Islamic studies will also finally see funding with more budget infusion given to Dep-Ed Central. The SONA last year extolled much of ARMM's depressing state in "ghost" schools. ARMM Watchers by the thousands have come out in the open to no longer fence-sit about a lost cause such as the ARMM . The cause could actually be won. One year later, President Aquino's SONA should note the ARMM "civilian uprising" in wanting good things to happen to their homeland.
Reform has been reverberating across the Muslim world most recently in the Arab Spring where authoritarian leaders in the Middle East fell in a domino phenomenon. People protested in a dramatic show of unity to denounce corruption and dictatorships.
Seeing the strong civilian push to clean up the registration process, we were asked by media about the Bangsamoro "spring" which pushed many of us to appreciate the necessity of getting in government months back. There may be no mobs, there may be no daily rallies. But the throbbing Moro collective just waiting to swell outside each one's cocoon is a sleeping giant.
Moro activism has transformed from the hard-line independence stand to the parliament of negotiations. One such example was the advocacy to push the August 2011 ARMM elections to May 2013.
Republic Act 10153 was signed into law June 30, 2011. RAN, the key player, in pushing such a historic law should commemorate such pivotal moment as a reform point in history. This is timely as two pillars in the Reform ARMM Now (RAN) movement, political analyst Raffy Nabre and Garci whistleblower Abdullah LACS Dalidig, passed away. Theirs is symbolic passing because one passed away from being killed, a signal that this fight to clean up the ARMM, has its dangers. The other passed from disease, an elderly who defied physical weakness to be strong and annul the Book of Voters which paved the way for reregistration in ARMM. Their torch must continue.

And so I thank PNOY for reminding of us of November 2009 when the Philippines saw a most grizzly show of corruption in the Southern Philippines where a local leader amassed wealth and power. This clan’s speedy rise to power in Maguindanao and ARMM did not show good governance. Instead it ended with the unresolved Ampatuan town massacre where more than 40 journalists and women were killed at gunpoint.
This brazen display of misgovernance aggravated by 21 years of a non-functional autonomy in ARMM inspired a movement called Reform ARMM Now (RAN), in calling for reform in all aspects of the autonomy and synchronizing of ARMM elections to 2013 in a law called Republic Act 10153.
RAN formed in late 2010 is a network and coalition of non-government, people’s and civil society organizations and individuals brought together under the banner of reforming ARMM.
Cyberspace was a major tool in getting the attention of national, regional and local stakeholders. ARMM Synchro law oppositor Senator Bong Marcos was even challenged to reply to twits by RAN writer Khal Mambuay. Senator Migz Zubiri resigned after a strong argument on electoral sabotage in Maguindanao was to surface with him benefiting in the infamous senatorial win of 12-0.
RAN developed a Roadmap for Reform which highlighted major agenda on fiscal , economic and socio-political reforms in ARMM (text is on reformarmmnow.org).
The success of the movement was seen in the passage of the Senate bill on the ARMM regional and national election Synchronization law and eventual signing of the law by President Benigno Aquino III who earlier gave a resounding SONA re "ghost" bridges and schools in ARMM.
RAN’s member organizations also pushed for the Supreme Court (SC) to declare the constitutionality of RA 10153 with Muslim lawyer Algamar Latiph arguing their case before the Supreme Court (SC). Vigils last December in the SC prodding the SC to decide in declaring the law constitutional exposed the weakness of the Chief Justice who in the next month faced an impeachment trial
President Aquino appointed officers in charge, Governor Mujiv Hataman and Vice-Governor Bainon Karon in December 19. And the Regional Legislative Assembly in April.
The executive officials through the Governor rendered their 100 day Report. The predominantly civil-society led RLA passed two laws creating a Human Rights Commission and the Public Works Act which junked the traditional district impact projects. Yet expectations remain that the reform Roadmap can still be realized.
RAN can play a pro-active role in advancing the reform agenda throughout the transition government and beyond. It has acquired ascendancy in its popularization with a facebook page read by reporters of the major newspapers - Inquirer, GMA, Business World and Mindanao papers.
The mid-term SONA may not have mentioned civil society though it was entitled REPORT KO SA BOSS. It was long and inspiring, getting me worried if I could survive my deathly high heels. But hearing the good news of being able to export rice soon made a youth leader feel that we could really contribute to the PATAS na LABAN in Government. No more palakasan, no more baluktot as echoed in several speeches in the ARMM by our Governor.
But without the community, aspiration and marching orders cannot trickle and go grassroot.
This Sunday, those who have worked on supporting the electoral reform track, hope to reconvene and invite, the SONA uncited from PPCRV, ALERT, its mother org Lanao del Sur People's Council and other ARMM Watchers. This is to give testimonial to the unsung heroes of a peacetalks they are "walking."
