Shooting Incident

Just this morning at around 8:15 a.m. a shooting incident took place at Dr. Samama Hospital,Barangay Poblacion, Datu Piang,Maguindanao. The said incident resulted a multiple gun wounds of the two casualties namely Arnel Kalim, 38 years old a Tiyakap Member and Normina Abpi, 40 years old Chairwoman and midwife of Barangay Olandang,Midsayap, North Cotabato who was shoot on her shoulder and abdomen. According to the PNP and military who investigated, the victims were sitting in the reception area when the two unidentified perpetrator fired them without hesitation. Currently the casualties are now in Notre Dame Hospital, Cotabato City for medical treatment. The PNP and Military are continuing their investigation for possible motive of the perpetrators.

Libertas the Lawyers League and PAHRA (Philippine Alliance for Human Rights Advocates) organized an E-Lawyering Project for the victims of Extra Judicial Killing, Enforced Disappearance and Torture. The Bangsamoro Center for Justpeace in the Phils. (BCJP) is one of the HRD’s assign in ARMM covering the areas of Lanao, Maguindanao and Cotabato City.
We are calling to all our partner organizations I/NGO, CSO’s and PO’s who advocates for the Human Rights Violation that if you have documented any incidents on this cases please contact us through email (bc.justpeace@gmail.net) or call us on 064-3902726.If you have any questions or clarifications please do so. Help us campaign “ STOP human rights violation”.
OBJECTIVES
*      To assist in preventing EJKs, EDs, acts of torture, and other human rights violations by providing legal counseling and representation in asserting the civil rights of the victims and HR defenders as these incidents transpire;
*      To assist in prosecuting EJKs, EDs, acts of torture, and other human rights violations by providing legal counseling to HR defenders in effectively documenting the incident;
*      To educate human rights victims and HR defenders about their rights and the remedies available to redress violations thereof;
*      To assist in referring human rights victims and defenders to legal service providers in the locality who can defend/prosecute cases before the prosecutors and in court.
SCOPE OF MOBILE LAWYERING SERVICES
*      Legal Advice, including appropriate steps and remedies to be undertaken by HRDs/victims/relatives.
*      Talk to relevant authorities in the field (PNP, AFP, CHR) as the incidents transpire.
*      Refer the incident to network members for further legal assistance/handling of case.
*      Assist in the Preparation of the incident report.
*      Assist in the preparation of complaints/petitions and other pleadings

Libertas league of Lawyers with PAHRA is in a partnership project called "E-Lawyering" (electronic lawyering) which will run for one year from July 1, 2012.  Pools of lawyers are on stand-by 12 hours (8 am - 8pm) a day and can be accessed through a call dispatcher who will alert the lawyer-on-duty.

The Lawyer will call the HRD for emergency legal advice needed by the victim as the latter's temporary legal counsel. The lawyer will also talk to authorities (Police/Military/Prosecutor, etc.) as necessary thus preventing further violations of rights of the victims and ensuring due process. 

Part of the project are 6 HRDs from (2) - ARMM, (2)-Reg 3, Reg 12, Reg 6 which are the priority areas of the project. However, Libertas agreed to PAHRA's request that reports of HRVs from other areas will also be accepted. 

CASES to be accepted are those emergencies in nature:  
With risk to life, security and property and specific cases of violation against women 
Arrest/Detention, Enforced Disappearance, Extra Judicial Killings, Torture
Rape in the context of IHL (International Humanitarian Law) and Arrest/Harassments of Women sex workers/prositute.

The perpetrators should be State authorities. The cause of violations need not be civil and political in nature only. Those cases of eco-soc rights violation will be accepted such as from mining, agricultural, environmental, labor disputes struggle areas.  

After each incident reported to the E-lawyering, all cases are expected to be documented using the CSO-Peoples Intervention and Monitoring Mechanism (CSO_PIMM).

To ensure security of system, only calls/SMS coming from our identified and reliable HRDs in our areas of work will be entertained.

CALLING HUMAN ALL RIGHTS LAWYER! SAVE LANAO AND MARAWI CITY FROM AFP's Oppression!


What happen to the "Jutsice system" in this part of the Archipelago(MARAWI CITY). Yesterday around 11 PM midnight, while everybody is enjoying the spirit of Ramadhan---a group of Law and former Students decided to bond and Visit one of the Cafe shop here in MArawi City--while they are 'bout to unload suddenly AFP elements belonging to 65th IB riding a korean type Army Car arrived and surrounded them and point their GUNS to this Poor students---they interogated one of them the driver who just 'bought the car whom i refuse to identify for reasons that there's case now in the court---the AFP elements without warrant of arrest accused the driver that his car is Marked only to turn out that the car is legal and clean but the AFP elements out of desperation--searched without warrant the CAR a hidden 38 revolver was found inside the CAR---because of frustration they took the driver to Agus 1 where the 65th IB is encamped---because of this reports already circulated in the RADIO and i was one of them who went to that CAMP to check---there were RUMORS that AFP elements summarily execute thier victims inside the camp---to my surprise while approaching the gate a drunk Soldier asking us why we are there i told him we just want to check the condition of that they are detaining---but he appears to be looking for a fight raising his voice against us---when the soldiers learnt that the one they took is a student leader and human rights Volunteer--they don't want to comment and said they will leave that to the due course of the LAW daw? searching w out warrants and illegal detention?...early Morning Friends and Relatives of that detained work   for his release----but not until afternoon where no Judge is around did they turned over and filed a case---so they can craft a case for they know they did something wrong--also this afternoon they released the CAR---even Prosecutors are affraid of this un usual movements by Military---this afternnon i checked at PNP HQ in MArawi CIty a similar case they also relate to us--another case of torture--the AFP turned over a man whom they accuse of Illegal position of fire arms---since no friends and relatives got to check on him he was tortured as in "Basag ang MUKHA"---san kami pupunta at hihingi ng tulong since our Politicians doe's not want to speak kasi baka mawalan sila ng security whom the AFP is providing the FEW na me kaya?---i learn from a source that the same 65th IB is the infantry assigned in MAguindanao during the "AMPATUAN MASSACRE" if this is the kind of behaviour that they are showing and GOD FORBID baka mangyare din sa lanao. wag sana...calling International HUman Rights Group to look into this Illegal detentions and Illegal arrests! We strongly condemn this kind of Acts!

Incident Report




Last July 24, 2012 at around 10:00 a.m. a shooting incident was happened in the Barangay Kanguan,Datu Piang,Maguindanao. The Municipal ABC president and at the same time the Barangay chairman of Barangay Kalipapa,Edris Ali and his son Kagawad Satol Ali of the said barangay were being shoot. According to the PNP who investigated, the victims attended a weekly session of the entire barangay chairman in all covered barangays in the Municipal Hall. While they were on their way back home riding their single motorcycle closes to the restaurant of one of the Tiyakap Kawagib team leader-Akmad Ali were the incident took place, an identified suspect immediately shoot down the said victims. They were brought to the clinic but suddenly Barangay Chairman died and his son was dead on the spot. The PNP said that Rido is the possible main root cause of the incident.
